    Where in the contract does it say they can refuse trip trades by phone for SWAP declared in all bases. If that is the case how does affect trip trading within the 24 hr rule for trips. Where is that in the contract? Can't call cant trade.......

    Does it matter if it's in the contract or not? The company hasn't been following (their end...you'll still be up to and including termination for not upholding your end) and the union has been upholding our contract for months now?

    21-H-4-e. If you want to trade a trip the day prior, you're sort of stuck.

    Of course, now you can't even help the company out with a bad/worse day trade. Oh well.

    I started trying to trade a trip on Saturday morning for a Monday AM departure. Was told, we were in SWAP and no trades were being accepted. The Scheduler said he couldn't see it lasting much longer. So I said, Okay I'll call later.

    At about 8:00 I called again, they said that they were still in SWAP no trades.

    Called again today at 1:00, told - no trading we are in SWAP.


    They are taking us for fools with this one! Declare SWAP and scheduling has total control to do what they want, irrespective of the Contract.

    My question is what conditions have to exist for the company to declare SWAP? Just because management has shorted themselves on crews isn't justification in my lowly opinion. It would seem to me SWAP is associated to WEATHER, not lack of management's foresight to properly staff this airline, as evidenced by POL-52 in the FOM:

    SWAP (Severe Warning Action Plan) is put into effect by ExpressJet Dispatch whenever severe weather or other situations will impact flight operations at a hub city.

    So I guess lack of staffing must be affecting ALL our HUB cities. Hoo-yuh...

    Happens every day in EWR. The CWAP hits the fan on a regular basis there.
